Legal Question in Criminal Law in Arizona
unknown warrant
I was pulled over last weekend and the cops informed me that I had a warrant for my arrest for two felony counts of possesion/use of a dangerous drug that dated back nearly four years ago. I animatedly declared that this wasn't me because the physical description and the address were both wrong, but they claimed they had my fingerprints. Now thinking back, I remembered getting stopped around that time with a small of amount of drugs for personal use, but the officers just let me go-and I definetely don't remeber them taking any fingerprints. Now my court date for this is in just a few days and I'm very scared; I live out-of-state where I am going to school, but I go to court the day I'm supposed to start school. I also currently have a full-time job here and am the single parent of a two-year old. I have no previous drug convictions and this would be my first offense, I would basically would like to know the worst and what probably would happen to me so that I can be at least somewhat prepared...please help.

What likely happened is that the prosecutor eventually charged the case and sent you a summons. Because you had moved, the summons was returned as undeliverable and a warrant was issued. The outcome of your case is somewhat unknown because it is likewise unknown what the police wrote in the report. Hoping that evidence is destroyed is very unlikely so don't hold your breath. Possession of Dangerous Drugs can typically be resolved with probation. This offense can not usually be handled with you remaining out of state. Old case, therefore check if drugs have not been destroyed and or if initial case was the result of a legal seizure.
