Canadian Citizen arrested for DUI

First time offense. My son has contacted doctors and will under go treatment in Canada and wants to meet the court date but what if he is still in treatment for alcohol abuse on 11/05/2007. He understands the seriousness of this and does not want to miss the court date. Does he wait until after the court date? He is at our home in Fl right now and is not sure whether to go home for the treatment or wait it out until after the court date.

This sounds like a reasonable grounds to request a continuance. Ask your lawyer to file a Motion to Reset with the court. If, as I suspect, your son is not represented by competent counsel, you might try calling / writing the judge or the clerk of the court. Also, call the prosecutor and explain the circumstances. They are often very helpful in these situations. It will help if you can state in your Motion to Reset that the State does not oppose your request. Good luck!
