Legal Question in DUI Law in Arizona

dui

When one has been arrested for a dui, and was already on fed probation, served a 6mo imprisonment (fed violation) can the state still sentence one for additional imprisonment? If they can, would they even put into consideration that the person had just served, and maybe lower their sentencing? I'm asking for my 26 yr old son. He was released today, and is now on the way home, via greyhound, compliments of the FBOP. Now he'll have face the state dui charges.

Re: dui

Year, the Federal and State governments are dual and independent sovereigns. The Fed jail time will not offset any State jail time relating to the DUI charge(s). HOWEVER, As long as your son is not charged with a felony DUI, he is only looking at a few days in jail.
