Should a DUI be taken off my record if there was no conviction?

I was cited for DUI in June of '99 in Glendale, AZ. I voluntarily suspended my liscence (I was told it would look better for auto insurance companies to do so). I was not convicted on this charge and the case was thrown out of court along with others because of some mistake made on the PD's side. I recently tried to get on the same low cost auto insurance plan as my fiance, but because the incident is still on my MVD record, I don't qualify and I'm paying about $40 a month more in insurance than I should. Shouldn't the courts take this off my record?

Yes. You need to contact MVD with a copy of the dismissal notice or a current court document evidencing the dismissal.
