First, if you are currently facing charges, you may want to have an experienced attorney represent you in court. As for a typical penalty, it often depends on the jurisdiction, but minor consumption is a misdemeanor. Since you did a diversion class the first time, that would not be a conviction. Barring anything else on your record, you would be facing a first offense misdemeanor, which is likely to result in probation and fines. The MVD may also take action against your driver's license, depending on the circumstances, and what charge you get convicted for at trial or plead to. It is important to consult an experienced attorney who knows the other possible penalties you may be facing and can discuss the specifics of your case.
