what are our first offense rights in getting our car back. my husband was arrested
last night. 1.08 level. he has to drive to work and we are really strapped for money he needs to work.

By the above, I assume you mean a .180. If he was a 1.80, you would be making funeral arrangements.
If the car is registered ONLY to you husband, it will be impounded for 30 days - No exceptions. If the car is registered jointly (i.e., you and your husband, etc.) with you husband and ANY other person, you can get it back right away. Just call the arresting police agency and ask for an expedited hearing. Bring to the hearing a copy of the title, registration, etc., showing joint ownership and you will get your car back right away. Merry Christmas, Ed Loss
