Technically the state has 1 year to file misdemeanor charges and 7 years to file felony charges. However, they are likely waiting for the blood test results before charging you. Be sure if/when you are charged to consult a qualified attorney directly. Do not represent yourself.
The law requires that the police officer have reasonable suspicion that a crime was committed or that a traffice violation ocurred before they can stop a motor vehicle. If there is no reasonable suspicion then the stop is unlawful and any evidence obtained as a result of that stop may be suppressed. Many issues can arise during an investigation of a possible driving under the influence of alcohol charge. It is always wise to consult with an attorney to review any DUI case for possible defenses to any charges.
