My question has to do with my younger brother who is 19yrs old. We live in arizona. My question is that my brother has friends at UofA he was there one night and campus police stopped him and his friends they ended up breathalyzing all of them. My brother does not drink alcohol but the policeman is charging him with MIP he asked the officer what he blew on the breathalyzer machine before a ticket was written the officer would not tell him my brother also asked for another test and the officer said its not needed is this legal can campus police falsely charge people? What should my brother do I don't want him to plead guilty when he's not court is very soon we don't even have money to pay for something like that especially for something my brother didn't do. Please help me!!!

Yes, police officers can make false accusations (not supposed and not legal to do so, but they can). However, until I or another attorney see the police reports I could not comment specifically about the circumstances. They will assert that they are reporting the truth; that is why we have trials. Your brother should consult an attorney directly about his circumstances, and certainly should not plead guilty without doing so.
