summary probation

I am on summary probation in Mohave Co. Arizona for a DUI. I understand I must notify the court of a change of address but do I have to ask the court for permission to move out of state? I have completed all other terms of probation and am current on my fine payment plan, I have 2yrs left on unsupervised (summary) probation

Since you are purportedly in full compliance with all of the terms of your sentence, ask your lawyer to file a "Motion for Early Termination of Summary Probation." Or, do it yourself. Just explain to the Court that you wish to move out-of-state, etc. If you file this motion without a lawyer, which you should not do, make sure you send a copy to the Prosecuting Agency. In fact, you might even call the Prosecutor before filing the Motion to make sure that he has no opposition (which he won't). Then, you can insert into your Motion, "Petitioner has spoken with Mr. Xyz of the Office of the Mohave County Attorney and is advised that his office does not oppose the instant prayer for relief."
