Legal Question in DUI Law in Arizona

surveillance cameras on private property

Can a recording from a surveillance camera be used against you if you're on private property (luxory condominium lobby etc) being given a ''sobriety test'' by a cop? Is it likely that said ''surveillance footage'' from parking garage, valet, etc., is available and easily accessible? Can a private citizen request these tapes? How would I go about doing this? I was charged with a bogus DUI and I wasn't even driving my car. What is or ISN'T on those cameras could be my whole case. So can/will Scottsdale Police Dept. go so far as to pull the tapes to disprove my case?

Re: surveillance cameras on private property

I am slightly confused as to the facts surrounding your question, however, if it would benefit you, a quality Defense attorney can subpoena the video and use it in your defense.

You should be aware that survelance tapes often tape over themselves at certain incriments. So dont wait too long in retaining an attorney or you may loose the proof you need to clear your name.
