Is the Verdict I Received for DUI for Real?
I was cited for DUI this past summer in AZ. These were the charges:
DUI[28-1381A1]
DUI w/AC .08 or higher[28-1381A2]
Extreme DUI .15% or higher[28-1382A]
Please note, these are ALL for the same 1st offense. And I went to court last week. So here's the verdict:
Not Guilty of DUI
Guilty of DUI w/AC .08% or higher
Guilty of Extreme DUI .15 or higher
Then the Judge sentenced me to the mandatory minimum sentence for the highest charge. He dropped the 2nd w/out prejudice & the 1st seemed to have any effect at all. The case is under appeal now, but not based on the verdict. Because the Judge disallowed most of the testimony of our expert on intoxilyzers. So all I could say at the trial was that I wasn't that drunk. I also testified that I attempted to get a blood test right after my release, but the hospital basically refused to do one ($800 cash up front, no VISA). So here is my question:
Does the verdict make any sense? Is this right? How can this be? And what can I do about it now?
I mean, how could I have possibly been found innocent & guilty of the exact same crime at the same time? I was told they're seperate laws but, by definition, the crime is common to them all, right?
