Is it illegal to have open sewage in yard and the fact it was not disclosed at time of move in.

Yes most city codes as well as county codes prohibit open sewage in a yard unless it's on an emergency basis and remedied as soon as practical. This is a health hazard that should have been disclosed before you even signed a lease or mortgage. Alert the environmental health authorities ASAP!
