Legal Question in Family Law in Arizona

2nd marriage, no divorce from first

I just found out the man I married in Arizona had never divorced his 1st wife and we have 2 children together.

Do I need to legally ''divorce'' him before I marry again.

This is a tricky issue. Technically, you do not have to file for divorce. I would encourage you, however, to file a "Declaration", and then also paternity documentation in order to establish support, custody and access orders.

I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia to schedule a free 1/2 hour consultation.
