Legal Question in Family Law in Arizona

my husband and i are separated but not legally yet. i am considering a divorce. our two childern stay with me at my parents. my husband wants to take the childern to wisconson for a week in july. he and his family drink alot and i dont want my childern to go. do i have the legal right to keep my children from going.

You of course have the right to protect your children, but these decisions need to be made very carefully. At some point in the future, you may have to explain your restriction, and if a Judge believes it to have been unreasonable, there could be repercussions in the overall custody matter.

It may be better to initiate legal proceedings to insure all of this is handled appropriately.

This is a VERY basic/general answer. If a divorce has been filed and served, the children are not permitted to leave the State of Arizona (during the divorce) without the other parent's written consent or an order of the court. All decisions are to be made in the best interests of the children.
