My Ex-wife has sole custody that was ordered when we both lved in N.C. One child will be 20 in July and the other is now 17. They have lived in Az. for 5 years and N.C. has a release of actions. the 17 year old would like to move in with me in Fl. for her 12th grade so that she can qualifiy for in-state rate for the medical school she would like to go too. What do I or the 17yr. old need to do?

Re: 17 year old custody

If you and your ex are in agreement that your 17-year-old can move to Florida, then she can just do it. If you want to do it right, which I would strongly suggest, you need to file a petition to domesticate your out-of-state court order and modify custody.

If you have to fight to make this happen because your ex won't agree, your fight will be in Arizona, since custody fights have to happen where the child lives.

In any case, you should talk to a custody lawyer before you do anything.
