Legal Question in Family Law in Arizona
Hello. My 19 year old son with my grandchild have recently moved back home after a break up with his girlfriend. The baby is out of wedlock. My son and the mother switch off ever 3 days which I think is ridiculous and it's always done on her terms and when she is ready. Here is the issue, my son would like to enlist in the air force and go active duty to get educated and have a steady income to provide for his son. In his absence he would like us to have his portion of the visitation/custody of the baby while he is away which this is going to be a issue with the mother. I've personally never done anything to her but for some reason she feels the need to threaten me with the baby as far as telling me I need to watch myself with her and that she controls wether I see my grandson or not. This baby is 5 months old and had not even had his first shots which I will be going down to get the birth certificate and making sure these things are done. What rights does my son have and what rights do we have as grandparents with my son enlisting? What steps do we need to take in order to be able to have the visitation and it temp custody of my sons portion? I am a stay at home mom so I'm here all the time and I babysit my grandbaby everyday my son had him and works.

You do have options that you can pursue while he is gone, including Grandparents Access or "Custody by a Non-Parent". Both have very specific requirements, and both give favor and power to the Mother. We can certainly help you consider and then pursue your options.
