Legal Question in Family Law in Arizona

Adoption

I recently found out that the father of my 3 year old is not her biological father, he wants to leagally adopt her. We are not married nor have we ever been. What do we need to do to make this happen

Re: Adoption

If you are not married to the dad, then he cannot adopt under current Arizona law. If you are married to him, however, then you either need the consent of the bio-dad, or you have to show the court that you have attempted to locate him and give him notice and he has failed to respond, thereby indicating consent.

I have helped people in both circumstances and I do so on a flat-fee basis, unless the case becomes contested. If you would like to talk to me or meet with me in person, please don't hesitate to call. I'd be happy to come to your home if Mesa is too far away.

Re: Adoption

If the two of you are married, and if the biological father consents (or if he can legally be established to have "abandoned" the child), then a step-parent adoption can happen. However, Arizona does not have a mechanism to permit him to adopt her if you are not married.

We offer a free initial consultation, so please contact our office to schedule a time to meet with Attorney Kristy Blackwell regarding the details of your situation.
