There are no restrictions on the age of the child. However, a baby would not be able to demonstrate they are living in an unfit home. An interested person may file for a guardianship of the child. If this is contested by the parents, then a dependency proceeding will be necessary. The child petitions the court through another, usually a guardian ad litem, who acts in the interest of the child legally. So, the child then brings the action himself or herself. This occurs when there are unfit parents.
