what age can a child legaly choose wich parent they want to live with

i had a child out of wedlock for the first few years he had nothing to do with her until she was 3 then he served with papers to modify custody at the time i was sick with cancer and young we got a lawyer threw low cost legal services.however his mother worked for a attorney high priced one at that we ended up not going to court but settling out since the money ran out now my dughter is ten she wants to live with me becuse she is treated bad thear i have no criminal record of any kind .her father is on med for depprison anmd she is left alone to take care og her brother and sister who are 4 and 5 .i would like to get her back living hear with me.

You have the absolute right to seek a change of custody based upon changed circumstances. I can explain the procedures better by phone or in person.
