Legal Question in Family Law in Arizona

Alimony

I am receiving free legal aid. She is not helpful what so ever in helping me to determine how much alimony to ask for monthly and for what duration. I have been married 26 years and always been a stay at home mom. My children are grown and gone. I am currently on my own in low income housing. I have been a victim of physical abuse. I am trying so very hard to make it but need some help in figuring this out. I would very much appreciate your help. THANKS!

1. ALIMONY: The facts you provided to appear to support a request for Spousal Support. First question, can your soon to be ex-husband afford to pay any alimony? If he can't, then any order won't mean much. Second question, what are your plans? Will you go back to school; do you have job prospects? Have you thought about what you want to be doing? The rural county judges I�ve worked with are very supportive of spousal support for a period of time while you go back to school or learn a trade that will allow you to support yourself. These matters are very fact specific, so you do need to discuss with your attorney and be sure a request for spousal support is in writing.

2. LEGAL AID ATTORNEY: Keep in mind that the volunteer attorney has many other clients and many other demands. Do you have e-mail correspondence with the attorney? This is one way I am able to communicate with my clients and they can put a quick question to me. Another suggestion, put down all your questions in writing, so when you talk with the attorney you don�t forget to mention or ask your questions. Finally, if the attorney does not return your calls, you can contact the Legal Aid referral office to see if they can help resolve the problem. Good Luck.
