Legal Question in Family Law in Arizona
In Arizona, at what age can a child decide whether or not he wants to visit a noncustodial parent? We currently have a court ordered agreement for every other weekend, however my 13 year old wants to go less and less.
1 Answer from Attorneys
There is no such age in Arizona. Instead, our statute requires that the Court consider the dsires of the children. Then, this factor is only one of many. However, the maturity of the child and the bases of the child's desires will certainly affect how much weight a Judge applies to the child's desires.
We can certainly help you consider and then pursue your options for modifying parenting time. This is obviously a very important matter, and you should not go in alone.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
