Can an attorney make a difference in the child support payments or is that all done by a formula regardless of what you fight for / agreed on. My wife and I have agreed on a child support amount, and does that mean anything in court? Our divorce is very uncontested. We sold the house, split the cash profit, we already split up every assest including the checking account, savings, and furniture, and now we have nothing and both live in seperate rentals....she has both kids (ages 8, 6) I make 65,000 a year she makes 32,000 a year, the only thing left is a court date and child support and alimony?? (married 10 years, shes 38). I am really not fighting for anything, just waiting to see what it costs me every month...would it be wise to hire an attorney or will I get the same response from the judge with or without an attorney?

An attorney can absolutely help re: spousal maintenance, because this is a very fact and argument oriented issue. An attorney can only make a significant difference in child support if there are fact issues regarding someone's income, daycare expenses, visitation credit, or some dispute over the other factors which go into a child support worksheet. If all the factors are agreed upon, then an attorney would make little difference.

Child support is calculated pursuant to statutory guidelines, but parties are permitted to deviate to a different amount by agreement. Spousal maintenance does not have an official statutory formula, so it depends on what each of you orders in court.
