Legal Question in Family Law in Arizona

Bad Attorney

i hired a attorney for my father in law for his divorce. He's attorney took his money and prepared his paperwork and that was about it. He did not help my father as far as letting him know what he needed to do or what to get for his case. As a result we feel this cost him every thing. Is there any thing we can do to try and collect are money back, or at least let other people know about this so they dont have to suffer like we did. thank you for any advice that you can give.

Are you certain that it was an attorney that you hired? There are some document preparers in town who are "former attorneys" who are not allowed to give legal advice or represent clients; they can only prepare legal paperwork. If you hired one of these individuals, you can request a refund on the grounds that you were misled to believe you had hired a practicing attorney.

If you did hire a practicing attorney, you can still demand a refund as a "dissatisfied" customer, but not getting what you want does not necessarily mean the lawyer did a bad job, so refunds are not easy to come by. If you truly believe the lawyer acted inappropriately, you can report him/her to the State Bar of Arizona and they may investigate to determine whether disciplinary action (including a refund) is appropriate.

In VERY serious cases, you might have an action for legal malpractice, but this is very expensive and extremely difficult to prove. It is only worth considering if (a) there is a lot of $$ at stake, and (b) you have a lot of $$ to fight with the lawyer's insurance co.
