Bankruptcy and support

Is child support and/or spousal support bankruptable? Orders have been in place for three years but there are seriuos arrearages.

Re: Bankruptcy and support

Nope. They are not. If the kids are all grown, there is not a lot you can do except continue paying down the arrears. If you still have a current child support obligation, you should consider modifying the child support downward to account for your current income so that you can make a greater payment on the arrears. Also, is your ex willing to waive a portion of the arrears? If you put the arrearage on a credit card or get a loan to pay it off, that debt would be dischargeable.

I practice both family law and bankruptcy so feel free to call me if you have questions.
