biological dad abandonment

My 3 step kids bio dad is across the country. He periodically calls, just to annoy my wife. Is there a period of time that he goes w/o calling in which we could file abandonment, in which i could adopt them? He refuses to sign over his rights.

Abandonment in Arizona is defined as 6 months of no contact and six months of no support.
