Legal Question in Family Law in Arizona
My boyfriend per his divorce decreed states that he has to pay his ex wife $75,000 in monthly payments of $1000.00 per month. The 75K total is based on her interest the home they shared. per decreed it states that should the home be sold she's to be paid off with proceeds from the sale of said home. Jan.5th 2010 that said home was foreclosed/sold at auction for $19K. He also owns a business but was awarded the business and structures and all tools etc, per the decreed. And at such time as she was paid in full he could remove her name from property title of business location. My question is this Should he still have to pay the $75K to her now that he no longer owns the residence which the amount was based on? And is it possible to modify the decreed beings how circumstances are now cosiderably different for him?
