Legal Question in Family Law in Arizona
My ex has not seen nor cared to see our son in almsot 11 yrs. As ofyesterday the amt of chilt support has increased a significnt amt. I a, now married & my Husband has been a Father to my Son all these yrs. My question is. If the biologocal Father decides to take me to Family court for visitations. Does my Son have to see him? I only ask this because my Son doens't want any part with him & refuses to even talk to him on the phone. So what happens if it's court ordered & my Son doesn't want to see or talk to him? Will the court take how he feel about him into consideration?

You could and should consider a "Petition for Termination of Parental Rights" based upon abandonment and non-payment. This would eliminte his ability to ever seek access. It would not necessarily effect his reuirement to pay child support (unless you also took the next step of allowing your Husband to adopt the child, which is also an absolute alternative).
We can certainly help you consider and then pursue your options.
One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.
Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation. Please ask that the consult be scheduled with myself or attorney Carlie Owsley Walker.
