Chances of getting primary residence?

My ex and I were never married and we have a 5 yr old son together. We had gone through mediation in the state of Texas which gave her primary residence however we have both moved out of the state and currently my son is with me for the year because my ex said that he was being to viloent toward her and his baby sister so she asked me to take him for the year and enroll him in kindergarten. I went to Utah and picked up my son the next day after she called and have enrolled him in school. However my ex is wanting him back in Utah no later then 1 week after school gets out for the year. This is not the first time she has asked me to take him for a year. I have no problem with it I just want a more stable environment for my son. What are my chances at getting primary custody of my son so that he can have a stable living environment? I do not want to take her rights away or keep her from our son but children need a stable environment and I am able to provide that for him.

You should file a motion to modify the primary residence of your son based on the parties' consent and action taken.
