change the last name of my step-child

My wife and I want to change the last name of her child, The fathers name is not on the birth certificate, and she wants to have the same last name as the rest of the family, I don't know how to go about getting her name changed. Do I have to adopt her, do I have to change her name on the birth certificate?

Thank you for your inquiry. You indicated that you are in WY, but your question relates to AZ law. I'm not sure of the connection, but I will respond according to AZ law.

In order to adopt your step-child, the paternal father's rights would need to be severed. This requires a finding of abandonment by the court. Your wife would be required to provide him with notice of the proceedings (if she can locate him).

In order to change your step-child's name, the biological father would also have to be given notice (if he can be located).

My specific recommendations would depend on the present status; is there contact with the father? was he ever granted paternity? do you and the mother have children together?
