Re: Changing States for Divorce

Yes, even though you may have been divorced in Arizona, the state were the children are lawfully living can take action to change child support. Normally, a certified copy of the Arizona order would need to be filed in Michigan along with a request to Modify Child Support. Any pleadings would have to be served on you. Most courts allow you to answer via mail and appear via telephone for hearings (but a Michigan attorney would be more familiar with the specific rules & procedures). If your ex has an open IV-D/Child Support Enforcement Case, they may be handling the matter on her behalf. You should be able to talk with the Michigan caseworker, if there is an open case, and you may be able to resolve the matter without a formal hearing. If it have been 1 or more years since your divorce set the child support amount, you could be looking at a change in the amount owed. (A Michigan attorney may know if they have an online Child Support Calculator, like Arizona does.) You can hire or consult with an attorney in Michigan. Good Luck,
