Child Custody

I have joint legal custody with my daughters. My ex is the custodial parent. My oldest daughter, who is sixteen, wants to move in with me. She is tired of the verbal abuse given her by her stepfather. Can she just move in without her mother's consent?

In a general sense, it is not a good idea to change custody without at the same time modifying the underlying custody\visitation court order, and perhaps looking at the child support ramifications. This can be done by written stipulation of the parties.

She COULD, but it is better that you take appropriate legal steps, especially since child support will continue to accrue unless legal steps are taken. If she just goes without COurt Orders, there can be repercussions.
