child custody
son unmaried, had child in 1995. went separte ways 9 months later. 1 month and cs was called mother left child with new boyfriend, drunk and sleep. police came took granddauther. took 3 days for my son to get her back. he has had her since then.
mother does not work, homeless sometimes. drinks, went to get child at school drunk, she would not go with her. called son, came and got her. wants to now file for full custody. found out also mother may have been collecting child support for this child who she has not had since she was 10 months old.
what does my son have to do to get custody of her? he is going to file some papers with the court. also can he file child abandment agaist her since she has never taken care of her.?
Does he have to prove he has taken care of her for the last 10 years or so? And if so how does he do this.? Thanks

Your son can and should seek custody Orders. He can also attempt to terminate Mother's rights due to the abandonment.

Proof that your son has had custody of the child for the last 10 years should be very simple. I can be done with school records and the statements of the child. The facilitator's office can probably help on this if he can't afford an attorney. Good Luck, Pat McCrary
