Legal Question in Family Law in Arizona
Child Custody
My wife and I are getting a divorce. She seems to believe that the mother automatically gets custody and I get to visit and have kids on weekends. We live in Pinal county. I want joint custody and equal parenting time. I am and always have been very active in their lives. What factors determine this and do my kids 11 & 9 have a say in what happens. What can I do to keep them out of it but also fight for our time.

Re: Child Custody
When it comes to custody and parenting time, there is no "automatic" schedule - it all depends on the best interests of the children. Several factors are considered, and one of the factors is the wishes of the children; however, with younger children, the wishes carry less weight. It is NEVER the children's decision to make.
Ultimately, there are many things to consider in deciding what type of schedule works best for your children. We offer a free initial consultation, so please call our office to arrange a time to speak with one of our attorneys about the details.
