Child Custody

My wife and I are getting a divorce. She seems to believe that the mother automatically gets custody and I get to visit and have kids on weekends. We live in Pinal county. I want joint custody and equal parenting time. I am and always have been very active in their lives. What factors determine this and do my kids 11 & 9 have a say in what happens. What can I do to keep them out of it but also fight for our time.

When it comes to custody and parenting time, there is no "automatic" schedule - it all depends on the best interests of the children. Several factors are considered, and one of the factors is the wishes of the children; however, with younger children, the wishes carry less weight. It is NEVER the children's decision to make.
