I serparated from my boyfriend and I have our 3 yr. old, he has made only one call to us in a year. I am now married and my husband wants to adopt my son. Can we claim abandonment and terminate the bio-father's rights. Do I have the right to refuse visitation to his father because of his criminal/drug abuse hisory? Can my husband still adopt if it is contested?

Thank you for your inquiry. Your husband can adopt your child if (1) the biological father consents; or (2) the court terminates the biological father's rights on the grounds of abandonment.
