Re: Can a child leave the state he lives in?
Arizona has a very specific statute as to whether a parent can relocate more than 100 miles away, or out of state, once custody and access Orders are in place. It basically requires 60 days advance written notice by certified mail, return receipt, after which the other parent can seek Court intervention to prevent the move.
If the move is objected to, the Court must consider the overall best interests of the child in deciding whether to allow the move.
I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
