Legal Question in Family Law in Arizona
Child support & custody, laws pertaining to two states, parents rights.
My daughter just gave birth in Arizona, plans to stay there with the baby. The father, who is not mentioned anywhere on the birth certicficate, lives in Virginia He is in the process of taking a paternity test. The father wants the baby to live in Virginia. If he fights for custody, what are the mother's and father's rights? How difficult is the situation because they live in different states? How does she find out how to get child support from him? His attitude is if the baby doesn't live in Virgia, he will refuse to give the baby support. He has health insurance, could the baby be on his plan? My husband and I live a short distance from the father here in VA. Is there anything we could do to help our daughter and grandbaby?

Support your daughter by financing a paternity, custody and child support action in Arizona. The case is not more complicated by involving two states. A child support order can require a parent to pay the child's health insurance. Seek the advice of AZ counsel on establishing personal jurisdiction over the father. Mother may have a custody advantage if she nursing the baby, and father abandoned her in AZ.
