Legal Question in Family Law in Arizona

Child Support, Medical Expenses, and Disability Income

My husband has shared legal and physical custody of his two children. One of them is deaf. He pays all the medical expenses for both children in addition to child support and the ex-wife gets to claim both children on ALL tax years. The mother is also receiving Social Security disability income on behalf of their youngest child. My questions are:

1) In the state of AZ, how should the disability income factor into child support? Additionally, if the mother is receiving the payments, is the father entitled to any portion of that income? Are there any legal documents accessible via the internet which are available to explain the guidelines regarding disability income with shared custody?

2) In shared legal and physical custody arrangements, what is the typical allocation of medical expenses and tax deductions? How is this impacted by the fact that the father pays child support?

3) Is there a specific length of time the father must wait after the divorce was finalized to go back to court and ask for a modification?

4) My husband, the father, was never contacted by Social Security. Since his son is receiving disability income, shouldn't someone have contacted him since he has 50% custoday?

Thank you for your help!!

Re: Child Support, Medical Expenses, and Disability Income

I can absolutely help with these questions, but there is too much typing for this kind of detail!

I can explain the issues and procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.
