Legal Question in Family Law in Arizona

Child support modification

My ex-wife is threatening to go after my current wife's income. She says that since my current wife has a son and we will claim him on our tax returns that she can legally go after my current wife's income and have it added to mine. She said her attorney told her that she could do this. I think she is bluffing, but I want to be educated before I respond.

Is this true? I thought no matter what, she could only go after the paying persons income and not the spouse of the paying person.

Re: Child support modification

Either she is bluffing, or she is getting advice from an attorney who does not know this area of law.

Your Wife's income cannot be used in any way for the purpose of calculating support or paying off debts.

I can explain the issues better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
