Legal Question in Family Law in Arizona

child support modification

How do we find out the mother's wages before deciding to file for a modification in AZ? My husband's first daughter has turned 18 and shouldn't have to pay for her anymore. The order was made 10 years ago or so. We wanted to make sure before filing what we were getting into.

Thank you,

Niki

Re: child support modification

If the child has emancipated, he has no additional obligation to pay child support. Thus, so long as he is current in all previous support amounts, he should Petition to stop paying.

We can absolutely help.

I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.

Please call me directly to discuss the specifics of your case, or contact my assistant Alicia or my paralegal Jennifer to schedule a free 1/2 hour consultation.

Re: child support modification

You should send her written notice of your intent to modify child support and that you need her income to complete the same. If she fails to responds, then file a simplified modification and estimate her income. If she disputes the modification, she will file an objection and note her true income.
