Legal Question in Family Law in Arizona

Child Support

I am the stepmother of 2 beautiful children. My husband and I are going for custody. When the 1st child was born the mother was married to another man and was placed on the birth certificate as the father. My husband then married her and paternity was established for this child and then they had 1 more. We recently discovered that the mother has been collecting child support for the 1st child for about 9 years now!! This child has been supportted by my husband all of her life. We have contacted the 1st husband to inform him of this. What leagally can be done? Can the 1st husband collect back the child support paid on this child? Incidentally the papers for both divorces list this child on their records. Is there any tax law this is in violation of? Thanks--Just trying to figure out all the lies-

Re: Child Support

This is a very complex issue, I would need to look at all the orders and determine who owes what. However, generally in Arizona you can only go back 3 years for past support. If you would like to discuss this further you may contact my office at 602-254-6008
