Legal Question in Family Law in Arizona
Child Support and taxes
My ex-husdand and were divorced over two years ago, in that time he sent two child support payment one the month of the divorce and the second a few months later neither payment was the full amount he was ordered to pay and i haven't heard from him since. The judge gave him the right to claim our son on his taxes on odd years and so last year i only claimed him as a non dependent. but when i went in this year i was told my son was already claimed. So now i have to refile and fight for the right to claim him. I was thinking maybe there was a way to make it so i can claim my son ever year. If he is not going to help support our child thats fine but then why should he still have the right to get a tax break for him? Is there anything i can do to change this?

Re: Child Support and taxes
You can absolutely file for modification AS WELL AS contempt for non-payment of child support. Our judges are usually relatively aggressive about deadbeat Dads.
I can explain the procedures better by phone or in person. As you can imagine, there is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Audrey to schedule a free 1/2 hour consultation. I look forward to talking with you.
