The only difference between having a child while married and not is that if you are married your husband's name would go on the birth certificate (unless of course someone admitted it wasn't his child or a paternity test was done). If you're not married, no father's name is going to go automatically onto the birth certificate, just the mother's (it's pretty hard not to prove who the mother is when you have just given birth). You can ask a court to establish paternity, say if you want to start receiving child support, and he can also ask a court to establish paternity, say so he can have visitation with the child. Let me know if you need further help.

Thank you!

Joan

Until he takes legal steps to establish his rights, he has none. However, it is sometimes still very important to allow access, since an unreaosnable refusal of access can be used against you in later proceedings.

We can certainly help you consider and then pursue your options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation
