A childs age to make own decisions

How old does a child have to be to make the decision of seeing the absent parent.

In Arizona there is no "magic age" where a child can make their own decisions. If the child has been emancipated then they of course could make their own decisions, but emancipation pleadings would have to be filed in superior court and granted by a judge. Additionally, emancipation requires that the child can support themselves and are capable mentally, physically, emotionally and financially to support themselves.

If your question pertains to making decisions regarding visitation and custody there is no magic age. The arizona statutes state that a child of reasonable age may be interviewed regarding their wishes, but those wishes are not controlling.

We don't have a statute that reflects the age a child can do that. THe child's wishes is among a number of different things a court has to look at in determining what should happen. THe older the child, the more weight his or her statements might be given.
