Legal Question in Family Law in Arizona
Not Through The Courts
My ex was granted ''primary care'' for our three kids four years ago. We have been doing the week on , week off visitation for about two years. He now wants to change it to me taking them a week and a half straight and him getting them every other weekend. He does not want to go through the courts. Should I take him back to court? what about child support and tax issues?

Re: Not Through The Courts
If you are agreeable to the changes, they certainly can be accomplished by Agreement. However, for several reasons, there should be a formal document setting forth the changes which can then be incorporated into a Court Order.
Child Support can of course also be modified to reflect the new plan. If you fail to "formalize" the Agreement, and fail to address child support, you may lose the right to seek support for the period of time following the Agreement.
I can explain the procedures better by phone or in person. There is too much to cover via e'mail. We offer free 1/2 hour consultations, in which we can discuss the matter in more detail.
Please call me directly to discuss the specifics of your case, or contact my assistant Cathy to schedule a free 1/2 hour consultation. I look forward to talking with you.
