Legal Question in Family Law in Arizona
custody of my granddaughter
This is a very long story, however, i will try to make it short. I have been raising my granddaughter since birth, she is 3 years old. i went to juvenile court to get guardianship because, the mother and father were incapable of parenting her, mother abandoned her, and when baby was 10 months old, mother had a stroke, father of baby is my son, who was on drugs at the time. this case hase been going on now for over a year. judge gave me phsyical custody. c.p.s. has been involved since the begining. mother is paralyzed on the whole right side of her body, has short term memory loss. c.p.s. is now giving my granddaughter to a person my granddaughter hardly knows. my granddaughter is now traumatized by this whole case. can i file for full emergency custody in family court? even though c.p.s. is still involved? my granddaughter is now going to her bio mom's for 5 days now next week. what can i do. mother has also accused baby's dad of molesting her. c.p.s. after a week later, said they dicided they were not going to do a forensic interview with my granddaughter.mother of child also is abusiveto my granddaughter, i have pictures of bruises and police report. need advice. a.s.a.p. thank you for you time.

Re: custody of my granddaughter
Was a Dependency case filed with the court? If yes, that would be the place to seek assistance first. The CPS caseworkers are very busy, but they should have time to talk with you about the status of the case, especially since they appear to have placed the child with you early on. If the court has returned custody to the parents, you may not have as good a chance of getting custody back. You should look for an attorney who has done this type of grandparent rights case before, not just an attorney who has represented parties in a dependency. You can ask the attorney about their experience, get specifics, before you hire them. Good Luck.
