Legal Question in Family Law in Arizona

custody

My husband's former girlfriend and he had a son. They never went to court to make anything legal. Yes his name is on the birth certificate. She said she could no longer handle son. Sent him to live here over a year ago. Does that mean she has given up any rights to him? Can she take him back anytime she wants?

YOu want to immediately move for a petition for custody in loco parentis, meaning standing in the place of a parent OR move for custody and make sure paternity is established. Without something more formal, she could show up at any time and take the child.
