Custody of Teenage Daughter

My 13 year old daughter has lived with me her entire life. Me and her father separated during my pregnancy. We lived in the same city for years, so he's always had weekend visits, even week days at times. We always had a ''open'' visit within ourselves. We never walked into a courtroom so I really don't have custody. right?

Now, we have been living with my boyfriend and his daughters out of state for the past three years. My daughter gets along fine with him but she's always been daddys little girl. She says she misses her daddy and he is wanting her to move back to live with him. What are the odds of him actually getting her? If he does file for custody, does he have to file where me and my daughter reside now?

To simply answer your question there is always a chance the other party may get cust. of a child. However she is at an age where her wishes might come into play..... good luck..

Thank you for your inquiry. In Arizona, if the parents were never married, the parent with whom the child has resided for the greater part of the last 6 months has legal custody of the child. Any order the court makes must be based on the best interests of the child.
