Legal Question in Family Law in Arizona

My daughter lives in Colorado with her two minor children. She wants to move to Arizona to live with us. The father of the children lives in Colorado. They were never married and never filed for custody or child support.

My question is, can she file for custody immediately upon arriving to Arizona or does she have to establish residency first?

Thank you

TYPICALLY, you must wait at least 6 months in order for Arizona to gain "home state" jurisdiction over the children. however, there may be claims for emergency jurisdiction as well. There are so many things to consider to answer this question, and so I certainly suggest a consultation.

We can certainly help her consider and then pursue her options.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Gloria or my paralegal Jennifer to schedule your free 1/2 hour consultation.
