Legal Question in Family Law in Arizona

My daughter (5 months old) was born out of wedlock. The father was not there for the pregnancy and is now saying he wants to be there for our daughter, but his actions speak more than his words. His has only seen her 3 times (1 hour each) since she was born. He is filing for joint custody and wants his name to be hyphenated in our daughters last name (Wortendyke-Menke). I do not want the name to be changed considering how little he has been around for our daughter. Would the judge leave the name the same (my last name) or will the judge hyphenate it?

For how young she is, in my opinion, the Judge is likely to hyphenate it.

We can certainly help you consider and then pursue your options for defending his requests. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
